On November 6, 2018, Supreme Court of Georgia adopted the first decision on the derivative lawsuit (Case N 687-658-2016). In this decision, Supreme Court cited the article of the Director of Tbilisi Consulting Group, Davit Maisuradze – “Business Judgement Rule in Corporate Law” (Corporate Law Collection I, ed. Irakli Burduli, Tbilisi, 2011, 113-117). Particularly, Supreme Court mentioned that “in modern corporate law utmost importance is paid to Business Judgement Rule – presumption according to which Directors are making their decisions in the best interests of the corporation on informed basis and in accordance with good faith, therefore, when suing the Directors, claiming party should overcome this presumption.”.
It must be emphasized that it is not the first case when scientific works of the Director of Tbilisi Consulting Group have been cited in court cases.
